Legal Definition Public Swimming Pool
“Private Residential Pool” means any pool or spa located on private residential property under the control of the owner or tenant, the use of which is limited to swimming or bathing by family members of the owner or tenant or their guests. “Owner” means any person who owns, rents or intends to own or rent a public swimming pool. “Spa” means a recreational or therapeutic hydrotherapy unit that is not emptied, cleaned or filled after each use. It may include, but is not limited to, units designed for the circulation of hydrojet, hot water, cold water, mineral bath, air induction bubbles or any combination thereof. General terminology for a spa includes, but is not limited to, therapeutic pool, hydrotherapy pool, spa, spa, and spa. “Public pool” means any pool or spa, other than a private residential pool or spa, that is intended to be shared by several persons for swimming or bathing and that is operated by a single person, whether as owner, lessee, operator or concessionaire, whether or not such use is subject to a fee. The term “public pool” includes, but is not limited to, tourist facilities, pools owned or operated by a condominium, private club or association of persons, dwelling or association of persons. The term “public pool” does not include insulated leg tanks and showers used exclusively for therapeutic purposes. “Pool” or “Pool” means any structure, pool chamber or reservoir located indoors or outdoors that contains an artificial body of water intended for swimming, wading pool, diving or recreational swimming, including spas and spas, and with a water depth of 24 inches or more at any time. “Agent” means a legally authorized representative of the Owner.
“Free disinfectant” means the measurable amount of chlorine or bromine that remains in the water after disinfection. The following words and terms, when used in this chapter, have the following meanings, unless the context clearly indicates otherwise. “Local Department of Health” means the department established in each city and county pursuant to Sections 32.1 through 30 of the Virginia Code. “Tourist Establishment” means any tourist establishment such as hotels, motels, bed and breakfasts, campgrounds or summer camps regulated by the State Ministry of Health. “District Health Department” means a consolidation of local health departments pursuant to Virginia Code Section 32.1-31C. `disinfectant` means the agent that disinfects by inhibiting, neutralising or destroying the growth of harmful micro-organisms; “Commissioner” means the State Health Commissioner or his subordinate to whom powers have been delegated under Article 12VAC5-462-40.
